Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Student", "Client") and Webectak ("Company", "we", "us", or "our") regarding your use of our website, educational programs (WebectakLearn), and development services.

By accessing our website, registering for programs, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you disagree with any part of these terms, you may not access or use our services.

User Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your account credentials

  • Respect intellectual property rights
  • Not interfere with or disrupt our services
  • Comply with all applicable laws and regulations
  • Treat instructors, staff, and fellow students with respect

Registration and Enrollment

Eligibility: You must be at least 16 years old to register for our programs. Minors require parental consent.

Enrollment Confirmation: Your enrollment is confirmed upon payment receipt and acceptance by Webectak.

Program Changes: We reserve the right to modify program content, schedules, or instructors with reasonable notice.

Prerequisites: Some programs may have prerequisites or skill requirements that must be met before enrollment.

Payment Terms

  • Currency: All prices are in South African Rand (ZAR)
  • Payment Methods: Bank transfer, credit card, or approved payment plans
  • Full Payment: Required before program commencement unless payment plan approved
  • Late Payments: May result in suspension of access to materials or services
  • Development Services: 50% deposit required, balance on completion/milestones
  • Price Changes: We reserve the right to modify pricing with 30 days notice

Cancellation and Refund Policy

Educational Programs

  • Before Program Starts: Full refund minus 10% administrative fee if cancelled 7+ days before start
  • Within First Week: 75% refund if cancelled within first 7 days of program
  • After First Week: No refunds, but credit towards future programs may be considered
  • Company Cancellation: Full refund if we cancel a program

Development Services

  • Refunds subject to work completed and project milestones
  • Cancellation fees may apply based on project phase
  • All work products remain property of Webectak until full payment

Intellectual Property

Course Materials: All course content, materials, and resources are owned by Webectak and protected by copyright. Students may use materials for personal learning but may not redistribute or commercialize content.

Student Work: Students retain ownership of original work created during programs, but grant Webectak permission to use anonymized examples for educational purposes.

Development Services: Upon full payment, clients receive ownership of custom-developed solutions, excluding any proprietary frameworks or tools used.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which forms part of these Terms.

We comply with the Protection of Personal Information Act (POPIA) and other applicable South African privacy laws.

Limitation of Liability

Educational Outcomes: While we strive for excellence, we cannot guarantee specific learning outcomes, job placement, or career advancement.

Service Availability: We aim for continuous service but cannot guarantee uninterrupted access due to maintenance, technical issues, or force majeure events.

Damages: Our liability is limited to the amount paid for the specific service. We are not liable for indirect, incidental, or consequential damages.

Termination

We reserve the right to terminate or suspend access to our services for violations of these Terms, non-payment, or inappropriate conduct. Students may terminate enrollment subject to our refund policy.

Upon termination, access to course materials and services will be revoked, though certificates earned remain valid.

Governing Law and Disputes

These Terms are governed by South African law. Any disputes will be subject to the exclusive jurisdiction of South African courts in Pretoria.

We encourage resolution of disputes through good faith negotiation before pursuing legal action.

Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email or website notice with 30 days advance notice. Continued use of our services constitutes acceptance of updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
